01Who we are and who these terms cover
Bossley Bears Volleyball Club is run by Bossley Bears Volleyball Club Pty Ltd (ABN 58 680 308 070, ACN 680 308 070), referred to here as “the club”, “we” or “us”. These terms apply to anyone who books, attends or pays for a Bossley Bears session, program, league or membership. By creating an account, booking or attending a session you agree to them. A parent or guardian agrees on behalf of a player under 18 and is responsible for that player's account.
02Bookings
Every player on court must be booked in. Casual players book one session at a time.
- Sessions have a player cap; when it is reached you can join the waitlist.
- Coaches may move you to a different session if the level is wrong for you or for the group.
- Your first class is $10, one per person, booked online through Start Here, and can be used for any session.
03Cancellations and strikes
Cancel from your account before the cut-off shown on the booking and the session returns to your allowance. A late cancellation or a no-show is one strike. Three strikes within 14 days is a $10 penalty, charged to your account. Strikes are recorded against your member ID.
04Payments and refunds
Memberships are billed weekly in advance. Casual sessions and class packs are paid when you book. Development Program blocks and Social League entries are paid when you register. Payments are processed by our booking platform's payment provider; the club never stores card numbers. Prices include GST.
- All fees are non-refundable. This includes the first class, casual sessions, class packs, membership fees, Development Program blocks and Social League entries. Your rights under the Australian Consumer Law are not affected (see section 08).
- If the club cancels a session, you get a refund or credit for it in full. If a coach asks you to sit out of a social games session because you are not yet at intermediate level, that session is refunded in full. Casual sessions you cancel before the cut-off are credited to your account.
- Class packs (5, 10 or 15 classes) never expire. Membership fees are not refunded for sessions you chose not to attend.
05Membership changes
Every membership runs week to week with no lock-in. Change plans or cancel with two weeks' notice from your account. Pause 2, 4 or 6 weeks a calendar year depending on your plan, with one week's notice.
06Conduct and safety
You agree to the Code of Conduct and to follow coach instructions on safety. Indoor, non-marking court shoes are required. Tell the coach about any injury or medical condition before the session. Every player needs a Volleyball NSW membership. A full membership includes personal accident insurance; the one-day introductory membership used for a first session does not, so you take part in that session without personal accident cover.
07Risk and liability
Volleyball is a physical sport with a risk of injury, including sprains, fractures, concussion and, rarely, more serious harm. By taking part you accept the obvious and inherent risks of playing. To the extent permitted by law, including the Civil Liability Act 2002 (NSW), the club is not liable for injury, loss or damage that results from those risks, or for lost, stolen or damaged belongings. Nothing in these terms excludes liability that cannot lawfully be excluded.
08Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms, including our refund rules, excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. If a service is not provided with due care and skill, or is not fit for the purpose we told you it was for, you may be entitled to a remedy, which can include a refund.
09Complaints and disputes
If something has gone wrong, email enquiries@bossleybears.com.au with your name, what happened and what you would like us to do. We acknowledge complaints within two working days and aim to resolve them within 14 days. Conduct complaints are handled under the Code of Conduct, and child safety concerns under the Child Safety Policy. If we cannot resolve a complaint about our services, you can contact NSW Fair Trading.
10Changes to these terms
We may update these terms. The version and date at the top of this page are the current ones; material changes are emailed to members before they take effect.
11Governing law
These terms are governed by the laws of New South Wales, Australia. You and the club submit to the non-exclusive jurisdiction of the courts of New South Wales.
